TERMS OF SERVICE

These Terms govern your use of PickSpot. By creating an account, obtaining a handle, or using the service, you agree to them, to our Privacy Policy, and to our Acceptable Use Policy. If you do not agree, do not use PickSpot.

1. What PickSpot is

PickSpot is a delivery-identity service. You share a PickSpot handle with merchants instead of your address; merchants send you order requests; you review, pay, track delivery, and confirm receipt with a one-time code (OTP). PickSpot coordinates payment, delivery, and confirmation. PickSpot is not the seller of goods — the merchant is, and is responsible for the products.

2. Eligibility and handles

You must be at least 18 and able to enter a binding contract. Your handle is a delivery identity licensed to you, not sold; PickSpot retains rights in the handle namespace. You may not sell, transfer, or misuse your handle or use another person's. We may reclaim or suspend handles for security, legal, or policy reasons.

3. Addresses

You may save one or more delivery addresses and choose one per order. Once payment is made and delivery has begun, the address for that order cannot be changed.

4. Orders and payment

A merchant creates an order request showing the product, photo, price, delivery fee, the PickSpot Customer Fee, and the total. You review and approve before paying. Payment is collected through a licensed third-party payment provider integrated with PickSpot; approving payment authorises us to process the transaction and begin delivery. Fees are set out in section 5.

5. Fees

You may be charged: the product price; a delivery fee; a PickSpot Customer Fee of 3% of product value; and applicable payment-processing fees. All charges are shown before you approve payment.

6. Delivery and confirmation

After payment, delivery is carried out by an independent third-party delivery partner; PickSpot coordinates but does not itself provide delivery and does not guarantee delivery times. On arrival you may accept the order by giving the rider your OTP, or reject it before giving the OTP (a reason and photo may be required, and the parcel is returned). Successful OTP verification confirms delivery and completes the order. Once the OTP is verified, the order is final.

7. Failed deliveries and refunds

If an order fails, our Refund & Failed Delivery Policy applies. In summary: if no parcel was collected from the merchant, you are refunded the product price, delivery fee, and PickSpot Customer Fee; if a parcel was collected and then returned, you are refunded the product price and delivery fee, and the PickSpot Customer Fee is not refunded. Payment-processing fees are non-refundable in both cases, as they are third-party costs already incurred. Your buyer protection runs up to the moment you give the OTP, so inspect before you confirm.

8. Acceptable use

Prohibited goods and conduct are set out in the Acceptable Use Policy, which forms part of these Terms. We may restrict, suspend, or terminate accounts, and delay refunds, for fraud, abuse, repeated failed deliveries, or breaches of these Terms or that policy.

9. PickSpot's role and liability

PickSpot provides delivery-identity, coordination, confirmation, and refund-administration infrastructure. It does not manufacture, own, inspect, or warrant merchant products. To the maximum extent permitted by law, PickSpot is not liable for merchant conduct or products, or for indirect or consequential loss; nothing limits liability that cannot be limited by law.

10. Changes, governing law, contact

We may update the service or these Terms; continued use after publication means acceptance. These Terms are governed by the laws of Kenya, and disputes are subject to the Kenyan courts. Questions: contact@pickspot.net.
